昨日，商務(wù)部、海關(guān)總署、市場監(jiān)督管理總局三部委發(fā)布聯(lián)合公告，自4月26日明天開始對出口非醫(yī)用口罩和醫(yī)療物資執(zhí)行更加嚴(yán)格的措施。
這次三部委在周六傍晚突然出臺的這份12號公告，是對以口罩為主的防疫物資出口祭出的最為嚴(yán)格的措施！目前為止很可能有部分企業(yè)已在口岸的產(chǎn)品就要被退關(guān)了，口罩出口的艱難程度再次雪上加霜！

Joint Declaration of the Exporter and the Importer

進口方承諾嚴(yán)格依照協(xié)議不將所購口罩用于醫(yī)用用途，并提示第三方不可用于醫(yī)用用途，如因進口方或第三方使用、維護、保管不當(dāng)造成損失的，出口方、生產(chǎn)廠商不承擔(dān)責(zé)任。
The importer shall commit to strictly abide by the agreement and not use the face masks it purchases for medical purposes and to warn any third party against using the face masks for medical purposes. The exporter or the producer is not liable for any losses caused by the inappropriate use, maintenance or keeping of the face masks by the importer or any third party.
本聲明一式兩份，雙方各執(zhí)一份。

對于新政策的推出，可以分兩部分進行解答：
第一部分：非醫(yī)用口罩
今晚24點前已經(jīng)進監(jiān)管區(qū)尚未放行的貨物。需要買賣雙方簽署《出口方和進口方共同聲明》，而后可被獲準(zhǔn)放行而不受名單影響。但是如果在不合格名單范圍中，則可能還是不允許出口。
4月26日0點后申報出口的貨物，必須同時滿足以下三個條件：
1、在商務(wù)部確認(rèn)取得國外標(biāo)準(zhǔn)認(rèn)證或注冊的非醫(yī)用口罩生產(chǎn)企業(yè)清單范圍內(nèi)或符合國內(nèi)質(zhì)量標(biāo)準(zhǔn)；
2、不在市場監(jiān)管總局提供國內(nèi)市場查處的非醫(yī)用口罩質(zhì)量不合格產(chǎn)品和企業(yè)清單內(nèi)；
3、需要買賣雙方簽署《出口方和進口方共同聲明》。
第二部分：醫(yī)療器械
自4月26日0時起，出口包括醫(yī)用口罩在內(nèi)的2020年第5號公告的醫(yī)療物資范圍中的產(chǎn)品，在公告基礎(chǔ)上增加了以下兩項要求：
1、商務(wù)部提供的取得國外標(biāo)準(zhǔn)認(rèn)證或注冊的生產(chǎn)企業(yè)清單；
2、出口醫(yī)療物資聲明。
這意味著企業(yè)既要中國的醫(yī)療器械注冊，還要符合境外的標(biāo)準(zhǔn)認(rèn)證或注冊，并納入國外官方準(zhǔn)入清單。
嚴(yán)格要求境外注冊
從公告中提到的《國外標(biāo)準(zhǔn)認(rèn)證或注冊的非醫(yī)用口罩生產(chǎn)企業(yè)清單》來看，非醫(yī)用口罩也必須取得進口國官方的注冊和企業(yè)準(zhǔn)入，這將進一步提高對非醫(yī)用口罩的監(jiān)管要求，而這個要求則符合小伙伴們在之前的猜測，即對出口產(chǎn)品的監(jiān)管責(zé)任主要在于進口國，只要進口國認(rèn)可了產(chǎn)品或生產(chǎn)企業(yè)，中國海關(guān)沒必要再做限制性措施。
特別提醒：在公告中有一個特殊的措辭 “對4月26日之前已簽訂的采購合同” ，對于這個合同簽署節(jié)點確認(rèn)的有點問題，目前海關(guān)應(yīng)該是無法確定的，所以可能會以是否已經(jīng)申報作為標(biāo)志進行一刀切的判斷。
對于目前已經(jīng)完成報關(guān)的朋友可以踏踏實實睡覺，明天安心上班，還沒報關(guān)的朋友請珍惜這幾個小時，一定要在24點之前申報完成！
